Agreement to these Terms

These Terms form an agreement between you and Zachary Zimmerman ("Daily Grid," "we," "us," or "our") governing dailygrid.app, its installed Progressive Web App, the Daily Grid iOS app, and related services (together, the "Services"). By using the Services, or by creating an account after being shown these Terms, you agree to them. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be legally able to agree to these Terms. If you are under the age of majority where you live, use the Services only with permission from a parent or legal guardian. Email accounts are optional. You are responsible for access to your email and devices, for keeping sign-in codes private, and for activity under your account.

2. Permission to use Daily Grid

We grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Services for lawful, non-commercial entertainment, subject to these Terms and applicable platform rules.

3. Intellectual property

Daily Grid's software, puzzle content, artwork, text, designs, names, logos, and other materials are owned by us or our licensors and are protected by applicable intellectual-property laws. Except for the limited permission above, no rights are transferred to you.

4. Gameplay, leaderboards, and profiles

Puzzle times, initials, ranks, achievements, streaks, friends, and equipped cosmetics may appear in the Services as described in the Privacy Policy. Do not submit offensive or misleading initials or attempt to manipulate scores, rankings, rewards, account ownership, or other players' experience. We may remove entries, reset affected results, or limit access when reasonably needed to preserve fair operation.

5. Acceptable use

You may not interfere with the Services; bypass access controls or request limits; access another person's account; submit malicious code; systematically copy or resell content; use automated means that burden the Services or distort gameplay; or use the Services in violation of law or another person's rights.

6. Accounts, deletion, and service changes

You may sign out or delete your account from Profile. Account deletion is permanent and removes associated server-side data as described in the Privacy Policy. We may change, suspend, or discontinue features, puzzles, rewards, or the Services. We will use reasonable care when changes affect account data, but we do not guarantee that every feature or historical record will always remain available.

7. Virtual items and future purchases

Achievements, badges, themes, taglines, and other virtual items are licensed features with no cash value and may not be sold or transferred unless we expressly provide a feature allowing it. If paid web features are introduced, price and payment terms will be shown before purchase.

Purchases in the separate iOS app are processed by Apple and may be supported by RevenueCat. Apple's payment, refund, subscription, Family Sharing, and cancellation rules apply. Manage an iOS subscription through your Apple ID settings.

8. Third-party services

The Services may link to or depend on third-party platforms. Their terms and privacy practices apply to their services. We are not responsible for third-party sites or services that we do not control.

9. Apple App Store terms

For the iOS app, these Terms are between you and Zachary Zimmerman, not Apple. We, not Apple, are responsible for the app, its content, maintenance, support, and product claims. Apple has no warranty obligation except any refund required by App Store rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the iOS-related provisions against you. You must also follow the Apple Media Services Terms and applicable Usage Rules.

10. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted operation, error-free puzzles, permanent availability, or preservation of streaks, ranks, or virtual items. Rights that cannot legally be disclaimed remain unaffected.

11. Limitation of liability

To the maximum extent permitted by law, Daily Grid and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or use arising from the Services. Our total liability for a claim will not exceed the greater of the amount you paid us for the Services during the prior 12 months or US $25. These limits do not apply where prohibited by law.

12. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except that mandatory consumer protections in your jurisdiction continue to apply.

13. Changes to these Terms

We may update these Terms as the Services change. We will revise the date and machine-readable policy version above and provide additional notice when required. Continued use after an update means you accept the revised Terms; if you do not agree, stop using the Services and delete your account.
